The ipod works just fine and only has some minor scratches on the back. ZERO scratches on the face of it as you can see in the pictures. The iPod does not come with headphones, but does come with the data cable seen in the photo.

It does need to be formatted before you can use it though. This can be done by opening iTunes on your computer, hooking the ipod to you computer using the sync cable and then following the format instruction boxes that pop up in iTunes.
